The terms that govern your use of our website, booking services, and stay at Third & Oak Suites.

These Terms & Conditions (“Terms”) govern your use of the website 3rdandoak.com and the booking, stay, and monthly parking services offered by Third & Oak Suites (“we,” “us,” “our”) at 315 S 3rd Street, Wilmington, NC 28401. By using the site or reserving a suite, estate buyout, or parking spot, you agree to these Terms. If you do not agree, please do not use our services.
Eligibility
You must be at least 18 years old and legally able to enter into a binding contract to book a suite, reserve the estate, or sign up for monthly parking. By booking, you represent that you meet these requirements and that the information you provide is accurate.
Bookings and reservations
Suite and estate reservations are subject to real-time availability. When you submit a booking, we request a live quote from our property management system, create a pending reservation, and redirect you to Stripe’s embedded checkout to complete payment. Your booking is not confirmed until payment is successfully processed and we issue a confirmation email.
Rates, fees, and taxes are displayed in the booking summary before you pay. Prices are quoted in United States dollars unless otherwise noted and may change between the time of browsing and the time of checkout.
Monthly parking subscriptions
Monthly parking at 315 South 3rd Street is offered as a Stripe-billed recurring subscription. Each spot is $100 per month plus a service fee that covers card processing costs. Your card is charged automatically at the start of each billing cycle. You may cancel your subscription at any time through our contact form or by emailing stay@3rdandoak.com. Cancellations take effect at the end of the current paid period; we do not prorate partial months.
Parking spots are assigned on a first-come, first-served basis. We reserve the right to reassign your spot to a different numbered stall within our lot when operational needs require it. All vehicles parked on the property must be registered with us via the signup form and must display current license plates.
Cancellations and refunds
Cancellation terms for a suite or full-estate booking are based on the policy displayed at the time of your reservation. In general:
- Cancellations made at least fourteen (14) days before check-in may be eligible for a full refund of lodging charges, less any non-refundable fees.
- Cancellations made within fourteen (14) days of check-in may be subject to partial or no refund, at our discretion and consistent with the policy shown at booking.
- No-shows and early departures do not qualify for a refund of the unused nights.
Wedding weekends, multi-night estate buyouts, and holiday reservations may carry a longer cancellation window. The policy applied to your reservation is the one shown at checkout and will govern any refund request. Approved refunds are issued to the original payment method through Stripe.
House rules
By staying at Third & Oak, you agree to follow the house rules provided in your arrival instructions. At a minimum:
- Quiet hours: 10:00 PM on weeknights and 11:00 PM on weekends, out of respect for our residential Historic District neighbors.
- Maximum occupancy: the guest count listed on your reservation. Unregistered overnight guests are not permitted.
- Smoking: prohibited inside all suites. Smoking outside is permitted only in designated exterior areas.
- Pets: not allowed on standard bookings. Wedding weekends at the full estate may accommodate a ring bearer or flower dog by prior arrangement.
- Events: we are not a ceremony or reception venue. Parties or gatherings beyond your registered guest list require prior written approval.
- Care of the property: guests are responsible for damage caused during the stay, including damage caused by members of your party or invitees.
Violation of the house rules may result in early termination of your stay without refund and additional fees for damages or cleaning.
Payment and fees
All charges are processed by Stripe. By providing payment information, you authorize us to charge the card for the booking total, any applicable taxes and fees, and any incidental charges you incur during your stay (for example, damage or excessive cleaning beyond ordinary turnover). Disputes about a charge should be raised directly with us first; chargeback requests made without contacting us may be contested.
Your content (forms, chat, reviews)
When you submit a contact form, send a message through our chat widget, or post a review, you grant us a non-exclusive, royalty-free, worldwide license to use the content you submit for the purpose of operating our service, responding to you, and (where appropriate) publishing reviews on our site or third-party platforms. You represent that the content you submit is yours to share and does not violate any law or third-party right.
You agree not to use our site, chat, or forms to harass, send spam, transmit malware, or submit unlawful content. We reserve the right to block abusive IP addresses and chat sessions at our discretion.
Intellectual property
All content on this website — including photography, copy, layout, and the Third & Oak name and marks — is owned by us or our licensors and protected by copyright and trademark law. You may not reproduce, redistribute, or create derivative works from our content without our written permission, except for personal, non-commercial use of publicly accessible information (for example, saving a booking confirmation for your records).
Third-party services and links
Our site integrates third-party services, including Stripe for payments, Hospitable for booking and calendar management, Google for maps and reviews, and Twilio and Quo for chat. We may also link to other websites for your convenience. We are not responsible for the content, privacy practices, or availability of third-party services, and your use of them is subject to their terms.
Disclaimer and limitation of liability
The website and services are provided on an “as is” and “as available” basis. We do not warrant that the site will be uninterrupted, error-free, or free from viruses or harmful components. To the fullest extent permitted by law, we are not liable for any indirect, incidental, consequential, or punitive damages arising out of your use of our site or a stay at our property. Our total liability arising out of or in connection with these Terms will not exceed the amount you paid for the booking or subscription at issue.
Nothing in these Terms excludes or limits liability for fraud, gross negligence, or any other liability that cannot be excluded or limited under applicable law.
Indemnification
You agree to defend, indemnify, and hold harmless Third & Oak Suites, its owners, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms, your stay at the property, or the conduct of your guests.
Governing law and disputes
These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-laws principles. Any dispute arising out of or related to these Terms or your use of our services will be brought exclusively in the state or federal courts located in New Hanover County, North Carolina, and you consent to the jurisdiction of those courts.
Changes to these terms
We may update these Terms from time to time. The “Last updated” date at the top of this page reflects the current version. Continued use of the site or our services after an update constitutes acceptance of the revised Terms.
